Rural producers live with a risk almost no other entrepreneur faces to the same degree: the weather. A prolonged drought, an off-season frost or a sudden drop in commodity prices can turn a promising harvest into a loss — and compromise the ability to repay the rural credit taken to fund production.
The good news is that the legal system recognizes the specific nature of rural activity and offers dedicated renegotiation mechanisms that are not always known to those in the field.
Extension of rural debt
When crop failure results from factors beyond the producer's control — drought, pests, flooding — it is possible to request an extension of the debt's maturity. The matter is so consolidated that the Superior Court of Justice issued Precedent (Súmula) 298, recognizing the right to extend rural credit in the cases provided by law, provided the payment difficulty caused by such events is proven.
Rural credit has its own rules. Treating it like an ordinary bank loan is a mistake that can cost the producer dearly.
The Rural Credit Manual and CMN rules
The conditions for funding, investment and marketing are governed by the Rural Credit Manual (MCR) and by resolutions of the National Monetary Council. Programs such as PRONAF, aimed at family farming, and instruments such as PROAGRO have specific coverage and renegotiation rules.
Possible paths
- Out-of-court renegotiation, directly with the bank or cooperative, seeking longer terms and re-framing of charges.
- Review of charges, where billing does not comply with rural credit rules.
- Defense in enforcement and repossession actions, discussing the extension and the amounts actually due.
The time to act
The sooner the producer seeks guidance, the greater the chances of reorganizing the debt without losing machinery, land or the next harvest. Gathering contracts, loss reports and proof of the weather event is the first step to assess, on a technical basis, the best strategy.
